Who issues your building permit in and around Kochi, KMBR or KPBR, self-certified permits for small homes on K-SMART, paddy land and data bank checks, conversion fees and CRZ limits, with official links.
Before you rely on any of this: Kerala rewrote parts of both building rulebooks on 29 October 2025, and its permit system has moved to K-SMART. This guide was updated in October 2026 and links to the gazettes and official pages it uses. Confirm the current position on K-SMART, or with an architect who has filed in your area recently, before you spend money. This is a plain-English guide, not legal advice.
In Kochi, your building permit comes from the Secretary of the local body your plot sits in: the Kochi Municipal Corporation, a surrounding municipality or a grama panchayat. Corporations and municipalities follow the Kerala Municipality Building Rules, 2019 (KMBR), panchayats follow the Kerala Panchayat Building Rules, 2019 (KPBR), and both now run online through K-SMART. A small house can get a self-certified permit with no wait for an officer.
The land decides more than the drawing, though. If the revenue record shows paddy land or wetland, or the plot sits near a tidal backwater, those checks come first.
Under rule 4 of the Kerala Municipality Building Rules, 2019, no one may build, rebuild, extend or alter a building without first obtaining a permit from the Secretary. The same rules define "municipality" to include a Municipal Corporation, so KMBR covers the city.
Where GCDA fits. The Greater Cochin Development Authority describes itself as the planning and development authority of the Cochin metropolitan area, working under section 56 of the Kerala Town and Country Planning Act, 2016. Its Planning Department scrutinises building plans and gives technical guidance to local bodies. For an ordinary house, though, the permit is the local body's. Where a site forms part of a Town Planning Scheme, the rules' NOC table lists the District or Chief Town Planner's concurrence, "if required".
KMBR 2019 (G.O.(P) No. 77/2019/LSGD) and KPBR 2019 (G.O.(P) No. 78/2019/LSGD) were both published on 8 November 2019. KMBR 2019 superseded the 1999 municipal rules, so any guide still quoting KMBR 1999 rule numbers is out of date. The amendments that matter for a house:
For what setbacks, coverage and height limits do to a plot, see our explainer on setbacks, FAR and height limits.
The 2025 permit application form asks for permissibility under the Kerala Conservation of Paddy Land and Wetland Act, 2008, and for the "type of land as per BTR" (the Basic Tax Register) and "type of land as per Data Bank". Check both before you pay.
The data bank is the list of paddy land and wetland prepared under the 2008 Act. Under the 2018 amendment to the rules, reproduced in the Revenue Department's Know Your Approval note on change of land type, the local body Secretary displays a copy on the office notice board and website. Our plot due diligence checklist covers the title and access checks to run alongside.
Treat it as land you cannot build on. The only route out is to show it was wrongly included: a Form 5 application to the Revenue Divisional Officer (RDO) to correct the data bank, with a ₹100 fee according to the Revenue Department note. In a February 2023 judgment, the Kerala High Court held that land becomes "unnotified", and a conversion application can be considered, only once the RDO has ordered its removal from the data bank.
This is "unnotified land", and section 27A of the Act lets the owner apply to the RDO to use it for a house or other purpose. Under rule 12, as amended in 2018:
The conversion fee depends on the size of the holding. The Supreme Court reproduced the government's notification of 25 February 2021 in State of Kerala v. Moushmi Ann Jacob (20 February 2025):
| Extent of the holding | Conversion fee |
|---|---|
| 25 cents or less | Nil |
| More than 25 cents | 10% of the fair value |
| More than one acre | 20% of the fair value |
The rates are the same in a panchayat, municipality or corporation. Two catches from that case:
On top of the conversion fee, the RDO's notice quoted in the judgment applies rule 12(9): ₹100 per sq ft of building above 3,000 sq ft, a figure Onmanorama also reported in March 2021. Never buy assuming permission will follow.
Much of Kochi sits beside the sea or tidal water, so the Coastal Regulation Zone (CRZ) Notification, 2019 applies. According to the state Environment Department's Standard Operating Procedure (January 2025), Kerala's Coastal Zone Management Plan was approved by the Union environment ministry on 16 October 2024 and applies from that date.
K-SMART, built by the Information Kerala Mission, launched on 1 January 2024 in corporations and municipalities. PTI reported that it reached all 941 grama panchayats on 10 April 2025. LSGD's building permits page says the architect or chartered engineer prepares the drawing on K-SMART, where GIS and e-DCR rule engines check it. (The Corporation's site still shows an older IBPMS link, which did not load on 16 October 2026.)
Under the 2025 amendments, a low risk house is a residential building with a built-up area under 300 sq m, limited to two storeys excluding the basement. For these:
LSGD's page says that once the drawing is submitted on K-SMART, the permit is issued in under 10 seconds. The same page describes low risk as below 10 m and 330 sq m, which differs from the gazette, so go by the gazette's 300 sq m and two storeys.
Larger buildings are scrutinised and permitted by the Secretary, who must decide within 15 days under the 2021 amendment. LSGD's page adds that you can appeal to the local body if the deadline passes, and if it does not decide within 30 days the permit is deemed granted. Under the NOC table, buildings over 1,000 sq m or 15 m need a Fire and Rescue Services NOC, and those between 300 and 1,000 sq m need a self-declaration with the architect's or engineer's certificate. A permit is valid for five years and can be extended once by five more; the 2025 rules allow a final five through the District Level Committee, up to 15 years in all.
Only registered professionals can file, so appoint your architect early. Check what the set should contain in our guide to the drawing set, and budget with our Kochi construction cost breakdown.
Plinth. When work reaches plinth level (pile cap, for pile foundations), your architect or engineer submits an intimation with plans showing the setbacks and dated photographs. No further work may continue until it is in, and if the Secretary sends nothing within seven days the inspection is deemed complete.
Occupancy certificate. The occupancy certificate comes from the Secretary. Under the 2025 amendment, a single or two-unit home of up to 500 sq m can get it once the structure, external doors, minimum sanitation and stair handrails are done.
Regularisation. Chapter XX of KMBR 2019 lets the Secretary regularise work done without a permit or in deviation of one, on payment of a compounding fee, but only if it does not violate the Act or the rules. It is a remedy, not a plan.
The Secretary of the local body: the Kochi Municipal Corporation inside the city, or the municipality or grama panchayat outside it. GCDA plans the metropolitan area but does not issue permits for ordinary houses.
KMBR applies in the Corporation and in municipalities; KPBR applies in grama panchayats. Both were rewritten in 2019 and amended on 29 October 2025.
For a low risk house, yes in effect: under 300 sq m built-up and two storeys excluding the basement, filed on K-SMART with self-certification. The Acknowledgement Certificate is deemed to be the permit.
Not on land in the data bank. If the land is recorded as paddy but is not in the data bank, apply to the RDO under section 27A in Form 6 or Form 7. The fee is nil for holdings of 25 cents or less and 10 per cent of fair value above that.
Often. The Corporation is classed CRZ II under the 2019 plan. The local body decides homes up to 300 sq m of plinth area; larger ones need KCZMA clearance.
Approvals go faster with someone who has filed locally before. Browse architects on MOA, see their work and message them directly, with no commission on either side.
